Terms of Service

Effective October 6, 2026

1. Agreement

These terms are an agreement between you and Node Coders LLC, a Texas limited liability company (“Orbgem”, “we”, “us”), the operator of orbgem.com and the orb command-line tool (together, the “service”). By creating an account or using the service you accept them. If you use the service on behalf of an organization, you accept them for that organization and confirm that you are allowed to.

You must be at least 16 years old to use the service.

2. Your account

You are responsible for what happens under your account. Keep your password and your API tokens to yourself: a token can write to your vault from any machine that holds it. Revoke a token in Settings as soon as you think it has leaked, and tell us if you believe someone else has used your account.

Give an email address you control. It is how we recognize you as the owner of the account when you ask for help.

3. Your notes are yours

Orbgem claims no ownership of anything you write, import or send to the service (“your content”). You give us permission to store, process and display your content only as needed to run the service for you: showing it to you, searching it, linking notes to each other and syncing it between your devices.

Notes are stored as the Markdown text you wrote, and you can export a vault as a .zip of .md files at any time.

You are responsible for your content and for having the right to store it, including anything your tools send through API tokens or alert webhooks.

4. Acceptable use

Do not use the service to break the law, to infringe anyone's rights, to store or distribute malware, or to store material you have no right to store. Do not attack the service, probe it for weaknesses without our permission, get around its limits, or use it in a way that degrades it for other people. Do not resell the service or give others access to it except through features built for sharing.

We may suspend or close an account that does any of this. Where the situation allows it, we will tell you first and give you a chance to export your notes.

5. Plans, billing and renewal

Solo is free and holds up to 1,000 notes and 100 MB of storage, counting your notes, the earlier versions kept in their history, and your images and video. What the free plan includes may change; if a limit is lowered, the notes you already have are kept and stay exportable, and the limit applies to adding more. Sync is a paid subscription at $8 per user / month, bought from Settings.

Sync is billed in advance and renews automatically each month until you cancel. Payments are handled by Stripe; we never receive or store your card number. Prices exclude taxes, which are added at checkout where they apply.

A Sync workspace can add storage packs in Settings → Plan: each adds 10 GB of storage for images and video for $2 a month, renewing with the subscription. Adding a pack charges for what is left of the current billing period at once, and the pack is added only once that payment succeeds. Removing a pack credits what is left of the period to your next invoice. Removing packs never deletes anything: a workspace that holds more than its storage allows can still read, export and delete, and cannot add more until it is back under.

If we change the price of a plan you are on, we will give you at least 30 days' notice, and the new price applies from your next renewal after that notice. If a payment fails and is not put right, the workspace returns to the free plan.

6. Cancellation and refunds

You can cancel at any time from Settings → Plan → Manage billing. Cancelling stops future renewals; Sync and any storage packs stay until the end of the period you have paid for. When a subscription ends, the workspace returns to Solo: your notes are kept and stay exportable, and limits of the free plan apply to adding more.

If you are not satisfied, write to support@orbgem.com within 14 days of your first payment and we will refund it in full. Beyond that, payments are not refundable and we do not give partial-month refunds, except where the law requires one or where we charged you in error. Deleting your account cancels its subscription immediately.

7. Availability and changes to the service

We work to keep the service available and your notes safe, but we do not promise uninterrupted service. We may add, change or remove features. If we ever decide to shut the service down, or to remove something you depend on from a plan you pay for, we will give you at least 30 days' notice and keep export working during that time.

8. Our software and name

The service, its software, its design and the Orbgem name belong to us. These terms give you the right to use the service; they do not transfer any of that to you. If you send us feedback, we may use it without owing you anything.

9. Ending the agreement

You can stop at any time by deleting your account in Settings, which removes the account, its workspace and every note in it. We may end or suspend your access if you break these terms. Sections that by their nature should outlast the agreement, including sections 8, 10 and 11, continue to apply.

10. No warranty

To the extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Export anything you cannot afford to lose.

11. Limit of liability

To the extent the law allows, Orbgem is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for all claims about the service is limited to the greater of the amount you paid us in the 12 months before the claim arose and 100 US dollars. Nothing in these terms limits liability that cannot be limited by law, or rights you have as a consumer that cannot be waived.

12. Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules, and disputes are heard by the state or federal courts located in Texas. If you are a consumer, you keep any protection that the mandatory law of your own country gives you.

13. Changes to these terms

We may update these terms. When a change is material we will post it here and show a notice in the app at least 14 days before it takes effect. If you keep using the service after that date, you accept the updated terms; if you do not agree, you can export your notes and delete your account.
